RSONS PS VIKAS PURI COMPLAINT UNDER SECTION 200 OF THE CODE OF CRIMINAL PROCEDURE FOR TRAIL OF OFFENCE UNDER SECTION 420/12B/34 IPC MOST RESPECTFULLY SHOWETH: 1. That the complainant was living with his family at House No. CD 44D, Hari Nagar New Delhi and working as branch manager in SBI Branch at Jaipur (Rajasthan). The complainant took VRS in May 2016. 2. That the complainant wanted to do some kind of business and threfore dicussed with his friend Sh Rakesh Khatri who lives in Vikas Puri, New Delhi and has his own business of Event Management. He told the complainant that he know one film producer Sh Rakesh Sawant and in the month of June, 2017, he took the complainant to meridian Hotel and arranged a meeting with Rakesh Sawant. In that meeting some other people were also present there. At that time said Rakesh Sawant put a proposal that he wanted to produce a Film and asked the complainant to invest some money in it. In the course of their discussion, he told the complainant that he has already discussed with his sister Rakhi Sawant about a film on the subject of Gurmeet Ram Rahim and also told that he has already produced many films and handsome money can be earned by producing that Film. 3. That one day Raj Khatri called the complainant over phone and asked him to come to his one of the Flat bearing No. H1/139, Vikas Puri New Delhi. When the complainant reached there, he found Rakesh Sawant present there. But both of them suggested that why not a Dance, Music and acting institure be opened in that Flat. Rakesh Sawant told the complainant that he has been running a similar institue in Agra UP and it was doing good business. In this connection he further told that he would bring his sister Rakhi Sawant for the inauguration of the institure, by this way a big name would be attached to their institute which would be very beneficial Rakesh Sawant also shown various Photographs of Agra's Institure and had told the complainant that his partner Lalit was running that institute well. He also suggested that Photos of Rakhi Sawant would be put on the Banners and hand bills. 4. That in this connection, one partnership Deed was executed on 3rd day of July 2017 by four partners and partners would invest money to execute and run institute accordingly. 5. That in the partnership, the share of complainant was 10% Rakesh Sawant's 30%, Raj Kumar Khatri 30 % and Arjun Diwan's 30%. 6. That Rakesh Sawant asked the complainant to invest Rs. 100000/- immediately so that the institute could be set up. In settling up of the institute Rs. 100000/- of complainant alongwith the share money of other partners were put to use by Rakesh Sawant according to his own plan, as Rakesh Sawant was carrying out setting up under his supervision and planning, therefore, he was comfortably staying in a room of that flat continuously since June 2017. 7. That Rakesh Sawant named the institute as Direct Bollywood action institute. He put up big posters having photos of himself

and MS. Rakhi Sawant. Simultanesously a bank account was opened in IDBI Bank in Vikas Puri New Delhi under the signature of all the four partners. 8. That in the monty of August, 2017 Rakesh Sawant put up another suggestion to the complainant that he was going to produce, with the help of investor another short Film “Salute to my Hero", which would be dedicated to widows of solders in a programme to be organized on 14th August, 2017. Rakesh Sawant decided to introduce a Model Rupa Khurana and inaugurate that short film on 14th August 2017. In the inaugunation ceremoney, the Chief Guest were Sh Ram Dass Atthawale, Central State Minister, Rupa Khurana, Rakhi Sawant and other persons and it was held in the prsence of media. It was all done to gain popularity for Rakhi Sawant and himself in the media. Later that time, Ram Rahim was a hot topic in the media, the complainant also thought that the offer was incirative. The said Rakesh Sawant told the complainant about an investor of Mumbai who are going to invest Rupee Rs. 3000000/- and showed the complainant dream of completing the shooting and releasing Film within 3 months. According to him total cost of the film would be Rs. 5000000/- and that he was looing for investor to invest Rs. 2000000/- Rakesh Sawant asked the complainant to invest Rs. 1000000/- and told that one person from Delhi was investing Rs. 

1000000/-. The repeatted requests of Rakesh Sawant and promise to start shooting at the earliest convinced the complainant and the complainant agreed to invest only Rs. 500000/-. 12. That on 13.09.2017 Rakesh Sawant got an agreeement signed from the complainant and asked him to pay Rs. 500000/-. The complainant transferred Rs. 500000/-. In the account of Rakesh Sawant's Axis Bank located at mumbai though NEFT From the account of complainant in Jail Road Branch of SBI and Rakesh Sawant gave to the complainant a cheque bearing No. 447680 dated 15.12.2017 of Rs. 700000/- payable at Axis Bank and promised that money will be returned during month of December 2017. 13. That on 19th September 2107, to shoot a song a Banquet Hall near Splash Water Park at GT Karnal Road, was booked and did the shooting there. In that song, Actor Ezaz Khan, Rakhi Sawant and other actor gave their performances. Arrangements were made to cover entire shooting by 6 to 7 media Channels. Now it seems that shooting was only to gain popularity in the media and a trick to fool the investors. 14. That in the course of Shooting Rakhi Sawant said to the complainant that you invest more money, the film would do good business. During shooting, Rakesh Sawant told the complainant 

that investor from Mumbai has backtracked, therefore, in whatever way he need rupees 1 to 2 lacs and asked the complainant to immediately arranges money otherwise shooting will be held up. To save his reputation and to complete the shooting the song, he repeatedly pleaded. Finally with the help of his friends, the complainant gave him rupees on lakh. 15. That next day after the completion of shooting, Rakesh Sawant over phone invited the complainant alongwith his family for the permier of the Film at "Taquila Restaurant, DDA Complex, Vikas Puri , New Delhi. In that programme, Ezaz Khan, Rakhi Sawant, Sh Lalit and another about 20 to 25 people were present and arrangement were made to get the full programme covered by media on the very next day of the programme, Rakesh Sawant alongwith his luggage disappeared from the flat No. H-1/139 Vikas Puri New Delhi, to an unauthorized location. Later on, through phone, it was discovered that he was in Mumbai, therefore, neither Film was completed, nor the institute could function. 16. That the complainant called the Rakesh Sawant several times on Phone and he made the complainant foold every time the complainant called and asked for his money back. Finally the cheque of rupees seven lakh given to complainant by Rakesh Sawant was deposited by complainant in his account, the bank returned it to the complaint with the objection, “Drawers signature Differ”. 17. That intentionally, Rakesh Sawant had put his wrong signature on the cheque as well as on Agreement and made the compaint to believe that cheque will be honoured. 18. That the complainant had taken the cheque in good faith but the cheque was bounced. 19. That accused took money dishonestly from complainant with bad intention and cheated the complainant. 20. That the accused persons dishonestly induces the complainant to do something which he would

otherwise have not done. 21. That the accused persons conspired each other to cheat the complainant and dishonestly induced the complainant to pay Rs. 600000/-. 22. That the accused no. 1 cheated the complainant by putting different signature of the cheque, knowingly and dishonestly and thereby committed an offence punishable under section 420 IPC. 23. That on 24.08.2018 the complainant served complaint to the SHO PS Vikas Puri Delhi. However local police did not take any cognizance, nor investigated the said complaint. 24. That the accused persons have committed the offences punishalbe U/S 420/120B/34 IPC and said offences are cognizable one. 25. That the accused persons are liable to be punished for the offences punishable U/S 420/120B/34 IPC and therefore, they should be tried and punished according to law. 26. That the concerned Police officials have not registered the FIR against the accused persons despite information given by the complainant about the cognizalbe offences committed by the accused persons. 27. That in view of the facts and circumstances narrated above, a Prima facie case is made out against the accused persons for which they are liable to be prosecuted. Prayer:- In view of above submissions, it is therefore, most respectfully prayed that the accused persons may kindly be summoned, tried and punished as per law for the criminal offences committed by them, under the relevant provisions of law.
