Delhi High Court gives a verdict in favor of AR Rahman

AR RahmanLet us tell you that the Delhi High Court on Wednesday rejected the decision of a single judge, which said that music director AR Rahman's composition 'Veera Raja Veera' for the Tamil film Ponniyin Selvan 2 (PS 2) is similar to 'Shiva Stuti' composed by Junior Dagar brothers - Ustad Nasir Zahiruddin Dagar and Ustad Nasir Fayyazuddin Dagar.

The judge said this

A bench of Justices C Hari Shankar and Om Prakash Shukla said that single judge Pratibha M Singh had found in principle that the junior Dagar brothers were also composers of the composition they had performed. "We have given a concurring opinion. We have held that the single judge erred on the principle and conclusion, which shows that since the junior Dagar brothers had performed the composition, it can be inferred that they were also composers. If we hold that a person performing a composition is a composer, we will have to rewrite the definition. On this basis, without considering the aspect of infringement, we allow the appeal."

This was the whole matter

The court delivered its verdict on an appeal filed by A.R. Rahman challenging Justice Singh's April 25 order. The April 25 order was passed in a copyright infringement suit filed by renowned classical singer Ustad Faiyaz Wasifuddin Dagar. Veteran classical singer Ustad Faiyaz Wasifuddin Dagar had said that the song "Veera Raja Veera" composed by Rahman resembles the traditional Dhrupad composition "Shiv Stuti" composed by his father and uncle, renowned Dagarvani musicians, the late Ustad Nasir Zahiruddin Dagar and Ustad Nasir Faiyazuddin Dagar.

The court imposed a fine of 2 lakh rupees

AR Rahman

Subsequently, on April 25, a single judge ruled in Dagar's interim injunction petition. The court directed AR Rahman and the filmmakers to credit the Dagar brothers on all online platforms. The court also imposed a fine of ₹2 lakh on AR Rahman and the producers and asked them to deposit ₹2 crore. Rahman subsequently appealed this order, and on May 6, a division bench stayed the interim injunction. The division bench also stayed the fine imposed on Rahman and the producers.
