Big Win for Aishwarya Rai Bachchan in Personality Rights Battle

Popular Hindi cinema actress Aishwarya Rai Bachchan, who was crowned Miss World 1994, has been away from the big screen (Aishwarya Rai acting career) for a long time. The Bachchan family (Bachchan Family) daughter-in-law is currently fully focused on raising her daughter (Aishwarya Rai daughter). However, despite staying away from films, she continues to remain in the limelight for various reasons.

In this context, Aishwarya has now approached the Delhi High Court. She has filed a petition seeking protection of her personality rights (personality rights), which means that no one should use a person’s name, image (image), voice, signature, or identity without permission. If any company or individual uses your photo, video, name, or AI-generated image for commercial (commercial) gain, you can invoke your personality rights to take action against them. She alleged that some people are using her name, pictures, and (AI generated) obscene content, which is entirely wrong.

Statement in the Petition

In her petition, Aishwarya (Aishwarya Rai Miss World 1994) stated that her photos are being used for commercial gain without her permission. The actress sought protection of her personality rights from the court. She mentioned in her petition, “Fake intimate pictures have been used to sell copies, mugs, and other merchandise. Also, screenshots have been tampered with, and all of these are AI-generated (AI generated).”

Lawyer’s Statement

Senior Advocate Sandeep Sethi (Senior Advocate Sandeep Sethi), representing Aishwarya, said that the actress wants to enforce her publicity and personality rights. He argued that some entirely unreal intimate pictures are circulating on the internet. Sethi added, “No one has any right to use her image, likeness, or personality. People are merely making money using her name and face.”

He further stated, “Her name and image are being used to satisfy sexual desires. This is very unfortunate.” The lawyer argued that some obscene platforms are using her morphed pictures. These platforms are making money by misusing her name and images in sexual scenes. Aishwarya Rai Bachchan was also represented by advocates Praveen Anand and Dhruv Anand. 

Court Rules in Favor of Aishwarya

While hearing Aishwarya’s petition, the Delhi High Court on Thursday, September 10, ruled in favor of the Bollywood actress and stated that her name, photographs, or any aspect of her personality cannot be used without her permission. Justice Tejas Karia restrained several companies and individuals, observing that such misuse not only causes financial loss but also harms her dignity.

The High Court clarified that if any organization or individual misuses Aishwarya Rai Bachchan’s identity, it could create confusion among people, leading them to believe that she is associated with that product or service. This, in turn, damages her name and reputation. The court further said that a person’s identity and dignity are integral parts of their life, and using them without consent amounts to a violation of the right to life and dignity.

This order is being seen as a significant step in the matter of personality rights, as celebrities have often raised complaints in the past about the misuse of their identity.
