Why did the court reject the relief petition?

High Court Justice Swaran Kanta Sharma on Wednesday dismissed Rajpal Yadav's plea, stating that there was no basis for granting him relief. The court stated that it cannot grant special dispensation to a person solely based on their profession or background. Yadav's lawyer had argued that the actor had arranged ₹50 lakh to repay the complainant and needed another week to pay the remaining amount. However, the court did not accept this argument.

This entire case dates back to 2010, when Rajpal Yadav took a loan of approximately ₹5 crore from M/s Murali Projects Private Limited to produce his directorial debut film, Aata Pata Lapata. The complainant company alleges that several checks issued to repay the amount bounced, following which a case was filed against Rajpal Yadav and a company associated with him under Section 138 of the Negotiable Instruments Act. During the trial, the Karkardooma Court issued several notices to Rajpal Yadav, but he failed to appear in court for a long time. In 2013, he was sent to judicial custody for 10 days. He spent four days in jail from December 3 to 6, 2013. Later, a division bench of the Delhi High Court suspended his sentence on his appeal. Rajpal's sentence was temporarily stayed.

When did the Delhi High Court stay the sentence?

Subsequently, the lower court sentenced Rajpal Yadav and his wife to six months' simple imprisonment, which they challenged in the High Court. In June 2024, the Delhi High Court temporarily suspended the sentence, stating that the actor was not a habitual offender and that there was scope for reform and resolution in his case. Based on this, the court advised both parties to explore the possibility of amicable settlement and referred the matter to a mediation center.
